A Legal Disclaimer
1. Reservation Conditions

The customer must be present at the time of the appointment; otherwise, the appointment will be cancelled, and a $140 travel fee will be charged.

The customer must confirm the planned works ahead of time. They must also be contactable prior and at the time scheduled for the job. Fees may apply if the technician drives to the property and the customer is not home. Otherwise, the job may be cancelled if no confirmation is received 24-hours prior.

By booking, you agree to all ATV Pest Control terms and conditions.
2. Cancellation Terms

A 24-hour notice is required to cancel or change your appointment. For cancellations or rescheduling, please call 0414 823 123 between 8am to 6pm or send us an email at info@atvpestcontrol.com.au

Once the technician arrives on site, if the client wishes to cancel or reschedule treatment, a $140 inspection fee will be charged.

All unpaid fees will be sent to debt collection for legal action.
3. Payment Terms

We only accept payment by cash or bank transfer.

If choosing to pay by cash, payments must be received upon completion of the service.

If choosing to pay by bank transfer, we need to receive funds prior to or within 7 days of the service.

Alternative payment arrangements may be agreed to before any service as agreed to by the Director of the Company.

ATV Pest Control commits to providing competitive and reasonable pricing for its services.

All payments received mean that you accept all ATV Pest Control Terms & Conditions.
4. Work Conditions

Throughout our services, technicians are not obliged to touch or move any furniture.

It is the customer's responsibility to prepare the property for treatment.

We do our best to cover all exposed areas but not hidden areas.

All images and videos taken by our technicians are only to be used for the purpose of the property report, to evaluate the condition of the property. Any media captured is not used for any marketing, advertising, or published on social media without the consent of the customer.

Technicians have the right to refuse service if they feel threatened or unsafe due to customer behaviour.

Abusive, threatening, or inappropriate behaviour towards our technicians will not be tolerated and may result in immediate termination of services.

Customers are required to maintain a respectful and safe environment for our technicians at all times.

Any incidents of harassment or abuse towards our technicians will be reported to the appropriate authorities and may result in legal action.

Technicians are instructed to leave the premises immediately if they encounter any form of abuse or harassment, and the customer will be charged a $140 travel fee.

If the customer is not available at the scheduled time, the technician will wait for a maximum of 20 minutes. If the customer does not arrive within this time, the appointment will be cancelled, and a $140 travel fee will be charged.

Customers must ensure that pets are secured and do not pose a threat to our technicians during the service.
5. Frequency of Pest Control Treatment

Our technicians will visually inspect the property and determine the condition, infestation, and property maintenance. Based on their findings, they will recommend tips and solutions to prevent any build-up of pests.

The frequency of pest control treatment depends on the location of your house and the pest density. If your home is affected by common pests such as cockroaches or spiders, a bi-monthly service should be adequate to keep them away. Usually, pesticides are effective for up to six months after application. With a bi-monthly service, a technician will be able to re-apply the products, so you always have a protective barrier for bugs. After the first few services on the bi-monthly pest control plan, all nuisance pests in your home are eliminated, and a more preventive approach is taken. The technician will advise whether a treatment is recommended every 6 or 12 months.
6. Warranty Conditions

We provide a warranty between 3 to 6 months, in writing.

Warranty will be provided at the discretion of the technician.

No warranties will be provided over the phone.

Not all properties can be provided with a warranty. Depending on the condition of the property, some properties may require more than one treatment to resolve the problem. The client must pay for all necessary treatments out of pocket.

No warranty is provided for any bed bugs treatment, German cockroach treatment, and/or any infested property.

Bed Bugs Warranty/Guarantee: We do not provide any warranty on bed bugs treatment; customers need to cover all treatments needed under their own costs.

ATV Pest Control warrants only what is outlined in the invoice given, and that the terms are adhered to.
7. Limitation of Liability

To the extent permitted by law, ATV Pest Control is not liable for any consequential, indirect, or special loss or damage of any nature whatsoever, including but not limited to those arising out of delay, loss of product, loss of production, business interruption, loss of revenue, loss of profits, or loss of opportunity.

Our liability to you under this agreement, whether in contract, tort (including negligence), or otherwise, is limited to the cost of supplying the services again or the cost of replacing or repairing the equipment, whichever is appropriate in the circumstances.

The parties must take all reasonable steps to mitigate any loss, liability, damage, cost, or claims incurred by them under this agreement.
8. Compliance with NSW Legislation

ATV Pest Control operates in compliance with all relevant NSW legislation, including the Biosecurity Act 2015 and the Biosecurity Regulation 2017, which govern the management of pest animals and ensure the use of humane and effective pest control methods

We adhere to the NSW Code of Practice and Standard Operating Procedures for pest control, ensuring ethical and humane treatment of all animals involved in our control programs.

Our business complies with all applicable work health and safety laws, environmental legislation, and industry standards as outlined by Service NSW.
9. Governing Law

This agreement is subject to the laws of New South Wales, and the parties submit to the jurisdiction of New South Wales.
